Mississippi's Recreational Market

Mississippi’s recreational cannabis market is not yet operational, as the state has not legalized recreational marijuana use. However, Mississippi does have a medical cannabis program that was signed into law in February 2022.

Under the Mississippi Medical Cannabis Act, qualified patients with debilitating medical conditions can access medical marijuana through licensed dispensaries. The program allows for the cultivation, processing, and sale of medical cannabis products to registered patients.

The Mississippi State Department of Health (MSDH) is responsible for regulating the medical cannabis program, including issuing licenses for cultivation, processing, testing, and dispensing facilities. The Department of Revenue is tasked with overseeing the taxation and revenue aspects of the program.

As of April 2023, Mississippi has begun the process of implementing its medical cannabis program, with the first dispensaries expected to open by the end of 2023 or early 2024. The program is expected to provide relief to patients suffering from conditions such as cancer, epilepsy, Parkinson’s disease, Huntington’s disease, muscular dystrophy, multiple sclerosis, PTSD, HIV/AIDS, Crohn’s disease, sickle-cell anemia, and Alzheimer’s disease, among others.

While there has been some discussion about the potential for legalizing recreational cannabis in Mississippi, no concrete steps have been taken in that direction as of yet. For now, the state remains focused on successfully implementing its medical cannabis program.

Mississippi's Road to Recreational

As of April 2023, Mississippi has not legalized recreational cannabis, and there is no clear road to recreational legalization in the state. However, there have been some efforts and discussions surrounding the potential for future legalization.

Metrc (Marijuana Enforcement Tracking Reporting Compliance) is a seed-to-sale tracking and regulatory compliance system used by several states with legal cannabis programs, including Mississippi. The software is designed to help state agencies monitor the cultivation, processing, testing, and sale of cannabis products, ensuring compliance with state regulations.

In Mississippi, the use of Metrc is mandated by the state’s medical cannabis program, which was signed into law in February 2022. The Mississippi State Department of Health (MSDH) is responsible for overseeing the program and has selected Metrc as the state’s official track-and-trace system.

Under Mississippi’s medical cannabis regulations, all licensed cannabis businesses, including cultivators, processors, testing facilities, and dispensaries, are required to use Metrc to track the movement of cannabis products throughout the supply chain. This includes:

  1. Tracking plant growth from seed to harvest
  2. Recording the weight and inventory of cannabis products at each stage of processing

Metrc uses RFID (Radio-Frequency Identification) tags to track individual plants and packages of cannabis products. These tags contain unique identification numbers that allow regulators to monitor the movement of products and prevent diversion to the illicit market.

By using Metrc, Mississippi aims to maintain strict control over its medical cannabis program, prevent the diversion of cannabis products, and ensure that patients have access to safe, tested, and accurately labeled products. The system also helps businesses remain compliant with state regulations, reducing the risk of penalties or license revocation.
